New York Court Granted Judicial Assistance Motion Against Brio Finance LLC and Brio Invest

Our international legal team is pleased to share a significant development in the case of our clients — shareholders of Brio Finance LLC and Brio Invest — on the path to justice. The United States District Court for the Southern District of New York has issued a ruling on the motion for judicial assistance under 28 U.S.C. § 1782, marking an important step in the fight against the financial fraud that has undermined our clients' interests.

Our clients are Russian companies and individuals who became victims of an extensive fraudulent conspiracy organised by the head of Brio Finance LLC and Brio Invest. The estimated amount of damages is approximately six million US dollars. In their pursuit of justice, our clients have conducted various legal proceedings in Russia, covering both civil and criminal cases.

The New York court concluded that our clients satisfy all the statutory requirements for obtaining judicial assistance in the United States — a significant achievement. Although the motion was granted only in part due to concerns related to privacy protection and the breadth of certain requests, this ruling nevertheless opens the door to obtaining important evidence and witness testimony needed to continue the fight for our clients' rights.

At the heart of the matter was a request to obtain testimony and documentation from the brother of the head of the companies in question — a person residing in the United States who owns luxury real estate and has business ties to the companies under scrutiny.

Despite the partial refusal, the court ruling represents an important step forward. We welcome the decision and are prepared to make use of the opportunities provided by the court to continue protecting our clients' interests.
